Robert Terry, the 65-year-old owner of Terry Contracting & Materials, Inc. from Southampton, has been indicted for failing to pay his employees the required prevailing wage rate, allegedly shortchanging them by approximately $83,694 during a public works project at the Davis Park Marina Improvement. Between March and August 2018, Terry misclassified his employees as "laborers," a lower wage category, while they were performing tasks that warranted a higher "dock builders" wage. Some employees who worked as crane operators were also omitted from certified payrolls.
Suffolk County District Attorney Raymond A. Tierney stated that Terry's actions deprived workers of their legally mandated wages. On December 12, 2024, he was arraigned on charges including Willful Failure to Pay the Prevailing Wage Rate and Falsifying Business Records. Despite the charges being classified as non-bail eligible under New York law, Terry is scheduled to return to court on January 23, 2025, and could face 1 to 4 years in prison if convicted. The case involves prosecution by Adriana Noyola from the Financial Crimes Bureau and an investigation conducted by the Suffolk County District Attorney’s Office.
