Governor Kathy Hochul's proposed budget for 2025-26 suggests streamlining New York's discovery rules, which have led to case dismissals due to strict timelines. Despite advocacy for these reforms, there is growing resistance, evidenced by a recent rally in New York City, and it's uncertain if the proposals will be included in the forthcoming budget from the Senate and Assembly.
Hochul's suggestions include clarifying subpoena requirements for discovery compliance, allowing prosecutors to certify discovery upon disclosing all relevant materials in their possession, expanding automatic redaction for sensitive information, and reducing pre-grand jury notice time from 48 to 24 hours.
