He criticizes New York’s current law, which ties drugged driving to a list of specific substances, making it difficult to prosecute impaired drivers using emerging or unlisted drugs such as nitrous oxide and household products. Despite recommendations from the National Transportation Safety Board (NTSB) to update the law, the legislature has failed to pass the Deadly Driving Bill (S.6485c/A3981c), which would address this loophole. Tierney highlights recent incidents, including injuries to workers caused by impaired drivers, as urgent reminders of the need for legislative action. He calls out legislative leadership for blocking the bill and stresses that all drivers should be held to the same standard regardless of the substance involved, to improve road safety and prevent needless deaths.
